Green granted a stay of execution

Hours before Green was scheduled to be put to death in Huntsville by lethal injection the Texas Court of Criminal Appeals granted him a stay of execution.
The delay is due to the court’s desire to review the standards used to determine Jonathan Green’s metal competence to be executed.
According to the Texas Attorney General's office Christina LeAnn Neal, a 12-year-old Dobbin resident, disappeared on June 21, 2000. Five days later the FBI began assisting in the search. The Bureau quickly found multiple items that belonged to Christina along the outskirts of the woods that ran adjacent to the Neal's home. On the 28th federal agents questioned Jonathan Green. He reported that he had no information regarding Christina's disappearance and agreed to a search so long as he was present. The agents, "noticed nothing significant." It was not until July 19th that investigators, once again, began to question Green's involvement . That morning a neighbor of Green's reported that Green had burned an "unusually large fire in his burn pile the day after Christina disappeared." The agents once again asked to search Green's property and he once again agreed with the same stipulations. While searching one agent noted that he smelled "some sort of decaying body." The team quickly located where the smell was most pungent and began to dig. Immediately Green became furious and demanded the agents leave. Later that night the team returned with a search warrant. When the investigators returned to the burn pile they discovered that the sight had been recently excavated. A "cadaver dog", which is specially trained to detect human remains, was brought to the property. The dog pinpointed a recliner in Green's home. The recliner was removed. Behind it was a bag containing the remains of Christina Neal's body.
An autopsy concluded that the victim was raped and ultimately strangled to death. DNA testing linked fibers found on the body to Green. Green, shortly after, was convicted of kidnapping, rape, and murder and was sentenced to death.
On December 17, 2004 the Texas Criminal Court of Appeals affirmed the conviction. During the trial the State provided evidence of Green's violent history. A witness claimed to have been raped by Green in July of 1999. This incident was just one of many. Green's violent behavior continued. Once in prison he assaulted fellow inmates and, on one occasion, an officer.
